01 Acceptance of Terms

By accessing, viewing, or using the Swioz Viewer application (“the Service”), you (“the User”) agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any part of these terms, you must not use the Service.

The Service is provided strictly as a utility for viewing and structuring publicly accessible information. Your use of the Service constitutes an acknowledgment that you understand the read-only, non-intrusive nature of the tool.

02 Nature of Service

Swioz Viewer operates exclusively as a read-only exploration surface. The Service functions identically to a standard, logged-out web browser fetching public web pages, but structures the output for easier viewing.

No Credential Handling

The Service never asks for, stores, or processes user credentials for any source platform. We do not log in to any source platform on your behalf. The Service cannot perform write actions, including but not limited to: posting, liking, following, commenting, messaging, or deleting content.

Public Data Only

The Service only retrieves data that is explicitly published as public. If a source platform requires a login to view specific content, Swioz Viewer cannot and will not access that content. The Service does not bypass paywalls, access controls, encryption, or authentication barriers.

03 User Responsibilities

You are solely responsible for how you use the data viewed or exported through Swioz Viewer. By using the Service, you agree to the following responsibilities:

• You will comply with all applicable local, state, national, and international laws and regulations.
• You will respect the Terms of Service of any source platform from which data is viewed.
• You will not use the data for unlawful, defamatory, harassing, or harmful purposes.
• You will ensure your use of personal data complies with relevant data protection laws (e.g., GDPR in the EU, CCPA in California), including obtaining necessary consent if you process personal data for commercial purposes.
• You acknowledge that the Service does not verify the accuracy, legality, or copyright status of the data it displays.

04 Prohibited Uses

You are expressly prohibited from using Swioz Viewer for any of the following purposes:

• Stalking, harassing, intimidating, or invading the privacy of any individual.
• Identity theft, fraud, or any other criminal activity.
• Distributing or selling personal data without the explicit consent of the data subjects.
• Attempting to reverse engineer, decompile, or disassemble the Service’s capture engine or infrastructure.
• Using the Service to overload, crash, or disrupt the servers or infrastructure of any source platform.
• Using automated scripts or bots in conjunction with the Service to mass-scrape data at a scale that violates the source platform’s rate limits or Terms of Service.

Violation of these prohibited uses may result in immediate termination of your access to the Service and may subject you to legal liability.

05 Intellectual Property

The content, data, and media viewed through Swioz Viewer remain the intellectual property of their respective owners. The Service does not claim ownership of any data captured from source platforms.

The Swioz Viewer name, logo, source code, interface design, and underlying capture engine are the exclusive intellectual property of Swioz. You may not copy, modify, distribute, or create derivative works based on the Service without express written permission.

06 Privacy & Data Handling

Swioz Viewer is designed with a privacy-first, ephemeral architecture.

• No User Accounts: The Service does not require you to create an account. We do not collect your name, email, or password to use the core viewer.
• Session-Based Captures: Data captures exist in your browser session for a maximum of 30 days. We do not maintain a long-term database of the captures you generate.
• Local Exports: When you export data (JSON, CSV, ZIP), that file is generated and downloaded directly to your device. Swioz does not retain a copy of your exported files.
• Analytics: We may use anonymous, aggregated analytics to monitor performance and prevent abuse, but we do not track the specific handles you search for.

07 Disclaimer of Warranties

The Service is provided on an “AS IS” and “AS AVAILABLE” basis. To the maximum extent permitted by applicable law, Swioz expressly disclaims all warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Swioz does not warrant that:

• The Service will be uninterrupted, secure, or error-free at all times.
• The data viewed or exported will be accurate, complete, or legally compliant.
• The Service will remain compatible with any specific source platform, as source platforms may change their infrastructure at any time without notice.

08 Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Swioz, its operators, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation:

• Loss of profits, data, use, goodwill, or other intangible losses.
• Damages resulting from your use of or inability to use the Service.
• Damages resulting from any action you take based on the data viewed through the Service.
• Legal action taken against you by source platforms, data subjects, or third parties as a result of your use of the Service.

Because the Service is provided free of charge (or without a transaction fee for the core service), Swioz’s total aggregate liability for any claims arising from the use of the Service shall not exceed the amount you paid to Swioz for the Service in the twelve (12) months preceding the claim, or $0.00 USD if no payment was made.

09 Indemnification

You agree to defend, indemnify, and hold harmless Swioz, its operators, employees, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including but not limited to attorney’s fees) arising from:

• Your use of the Service or your violation of these Terms.
• Your violation of any third-party right, including copyright, privacy, or publicity rights.
• Your violation of any law, rule, or regulation, or the Terms of Service of any source platform.
• Any misuse of the data viewed or exported through the Service.

This indemnification obligation survives the termination of your use of the Service. If you are sued by a third party (including a source platform) for your use of the Service, you are solely financially responsible for your own defense and any resulting judgments.

10 Termination

We reserve the right to suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including if we believe you have breached these Terms or used the Service for prohibited purposes.

Upon termination, your right to use the Service will immediately cease. Any active captures or session data associated with your usage may be destroyed immediately.

11 Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use the Service after revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you must stop using the Service.

12 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the operator of Swioz resides, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the courts located in that jurisdiction, and you consent to personal jurisdiction and waive any objection to venue in those courts.
